About terms

Welcome to Piggy - the private micro payment system. We have built Piggy to relieve your customers' pain with frequent, small-value payments to you in your fitness, coffee lounge, canteen or restaurant. We have tried to write these terms as simple as possible to express rules for use. Due to complexity of nowdays legal system, however, it was not trivial task. Should you have any concerns or questions regarding Terms, please, do not hesitate to contact us.

General terms

For the purpose of these Terms, we understand Piggy as a "Service" which is used by you as a "Merchant" who provides goods and services to your customers referred to as "Users" for which the Service maintains account information including transaction history. Service is provided by t16.biz s.r.o. ("us") incorporated in Czech Republic, Brandýská 712, CZ-25065 Bašť. Purpose of the service is to help you keep information about prepaid accounts of your customers with ease and instant identification of the customer and the point of sale by means of NFC technology. The Service does not issue electronic money which would otherwise require license from the central bank. Users do not give us any money. You take money from customers, instead and keep evidence about it with the help of the Service.

Provision of the Service

You acknowledge and agree that the form and nature of the Services which t16.biz provides may change from time to time without prior notice to you. t16.biz may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally at t16.biz’s sole discretion, without prior notice to you. You may stop using the Services at any time. You do not need to specifically inform t16.biz when you stop using the Services. In case you have paid monthly subscription, your subscription will terminate first day of the next month. You acknowledge and agree that if t16.biz denies access to your account, you may be prevented from accessing the Service, your account details, account balance or other content which is contained in your account. We will do our best, however, to provide you with all the data even after your account was disabled in order to get information mainly about Users balance and transaction history as soon as possible.

Use of the Service

You are, as a Merchant, responsible for provisioning new User accounts which belong to your customers. You are responsible for proper identification of the User and for entering proper amount of deposit you take from the User. Service provides following data fields for User identification: name, e-mail address, phone number, contactless chip ID. You are responsible for proper association of contactless chip to the User by means of NFC reader device or your NFC mobile phone with Piggy application. User can use any compatible contactless chip as long as chip ID is identified by the Service and chip is not already registered by another User of the Service globaly. Service DOES NOT modify contactless chip in any way. The service use contactless chip unique ID which is invisible and readable only by NFC-enabled equippment. In case User requests to assign unprovisioned contactless chip to some existing User account, you are responsible to verify that person presenting contactless chip is actual User and owner of the Account.

Exclusion of Warranties

NOTHING IN THESE TERMS, SHALL EXCLUDE OR LIMIT T16.BIZ’S WARRANTY OR LIABILITY FOR LOSSES WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR LOSS OR DAMAGE CAUSED BY NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF IMPLIED TERMS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, ONLY THE LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK AND THAT THE SERVICES ARE PROVIDED "AS IS" AND “AS AVAILABLE.”
IN PARTICULAR, T16.BIZ DO NOT REPRESENT OR WARRANT TO YOU THAT: (A) YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS, (B) YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR, (C) ANY INFORMATION OBTAINED BY YOU AS A RESULT OF YOUR USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE, AND (D) THAT DEFECTS IN THE OPERATION OR FUNCTIONALITY OF ANY SOFTWARE PROVIDED TO YOU AS PART OF THE SERVICES WILL BE CORRECTED.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM T16.BIZ OR THROUGH OR FROM THE SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TERMS.

Limitation of Liability

SUBJECT TO OVERALL PROVISION ABOVE, YOU EXPRESSLY UNDERSTAND AND AGREE THAT T16.BIZ SHALL NOT BE LIABLE TO YOU FOR: (A) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. THIS SHALL INCLUDE, BUT NOT BE LIMITED TO, ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY), ANY LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY LOSS OF DATA SUFFERED, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR OTHER INTANGIBLE LOSS; (B) ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE AS A RESULT OF: (I) ANY CHANGES WHICH T16.BIZ MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE SERVICES); (II) THE DELETION OF, CORRUPTION OF, OR FAILURE TO STORE, ANY CONTENT AND OTHER COMMUNICATIONS DATA MAINTAINED OR TRANSMITTED BY OR THROUGH YOUR USE OF THE SERVICES; (III) YOUR FAILURE TO PROVIDE T16.BIZ WITH ACCURATE ACCOUNT INFORMATION; (IV) YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL.
THE LIMITATIONS ON T16.BIZ’S LIABILITY TO YOU IN PARAGRAPH ABOVE SHALL APPLY WHETHER OR NOT T16.BIZ HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

Changes to the Terms

t16.biz may make changes to the Terms from time to time. When these changes are made, t16.biz will make a new copy of the Terms available at http://www.piggy2pay.com/en/terms. You understand and agree that if you use the Services after the date on which the Terms have changed, t16.biz will treat your use as acceptance of the updated Terms.
